Welcome to Spellbinder. These Terms of Service ("Terms") govern your access to and use of Spellbinder's website, applications, content, and related services (collectively, the "Service"). The Service is provided by Spellbinder LLC, a Minnesota limited liability company ("Spellbinder," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Spellbinder is an independent Magic: The Gathering resource and is not affiliated with, endorsed by, or sponsored by Wizards of the Coast LLC.
1. Eligibility and accounts
You must be able to form a binding agreement to use Spellbinder. Spellbinder is not intended for children under 13, and you may not use the Service if you are under 13. If you are under the age of majority where you live, you may use Spellbinder only with the permission and supervision of a parent or legal guardian.
If you create an account, you are responsible for your account, your connected login methods, and activity that occurs under your account.
When you create or maintain an account, you agree to provide accurate information and keep it reasonably up to date. You are responsible for maintaining the confidentiality of your authentication credentials and for notifying us if you believe your account has been compromised.
2. What Spellbinder provides
Spellbinder provides tools and content for browsing Magic: The Gathering cards, decks, tournament information, player data, metagame information, and related materials. Spellbinder also offers account-based features such as profile pages, deck creation, collection tracking, binders, bookmarks, and account settings.
Spellbinder is an evolving alpha product. We may add, remove, suspend, or change features at any time. We do not guarantee that any feature will remain available, or that any data, ranking, deck classification, card pricing, tournament information, or saved content will always be complete, current, available, or error-free.
3. Acceptable use
You agree not to:
- use Spellbinder in violation of any law or regulation;
- interfere with or disrupt the Service, including by probing, scanning, bypassing, or testing security measures without authorization;
- scrape, harvest, or systematically extract data from the Service in a way that imposes unreasonable load, circumvents rate limits, or exceeds any permissions we provide;
- upload or submit unlawful, infringing, defamatory, harassing, abusive, or deceptive content;
- impersonate another person or misrepresent your affiliation with a person or organization;
- use the service to distribute spam, malware, or other harmful code;
- use bots, scripts, or other automated methods to access account-only or user-specific areas except as we expressly allow;
- attempt to access data that you are not authorized to access.
We may investigate misuse and may suspend or terminate access, remove content, or take other appropriate action.
4. User content and sharing
Some Spellbinder features allow you to submit or manage content, including deck titles, deck descriptions, decklists, collection metadata, binder details, profile information, avatars, social links, and messages sent through our contact form.
You retain ownership of content you submit, but you grant Spellbinder a non-exclusive, worldwide, royalty-free license to host, store, reproduce, adapt as needed for technical operation, and display that content in connection with operating and improving the service.
If you mark a profile, deck, collection, or binder as public, you understand that it may be visible to other users and to search engines or other crawlers that access public pages. Public content may also be copied, cached, quoted, or reshared by others outside our control even after you later change or remove it.
You represent that you have the rights necessary to submit your content and that your content does not violate these Terms of Service or any third-party rights.
If you send us feedback, feature ideas, or suggestions about Spellbinder, you permit us to use them without restriction or obligation to you.
5. Intellectual property
Spellbinder and its original software, design, branding, and site content are protected by applicable intellectual property laws. Except as expressly permitted by these Terms of Service or by law, you may not copy, modify, distribute, sell, or create derivative works from Spellbinder or its content.
Magic: The Gathering names, logos, card names, card images, and related intellectual property belong to their respective owners. Spellbinder uses third-party data and intellectual property subject to applicable permissions, licenses, and policies, including Wizards of the Coast's Fan Content Policy where applicable.
6. Third-party services and links
Spellbinder relies on third-party services and data providers, including authentication, database, storage/CDN, email, hosting, infrastructure, marketplace, and card-data providers. Spellbinder may also link to third-party websites, including marketplace or retailer pages.
Those third-party services operate under their own terms and privacy practices. Spellbinder is not responsible for third-party websites, services, products, or content.
Some outbound purchase links may include affiliate or referral parameters. If you click those links and make a purchase, Spellbinder may receive a commission or attribution credit at no additional cost to you unless the third party states otherwise. Product availability, order fulfillment, pricing, returns, and customer support for those transactions are handled by the applicable third party, not Spellbinder.
7. Disclaimers
Spellbinder is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
Spellbinder is for informational and organizational purposes only. Card prices, tournament results, deck classifications, legality information, purchase links, and other data may be delayed, incomplete, unavailable, or inaccurate. You are responsible for independently verifying any information you rely on. Because Spellbinder is an alpha product, bugs, downtime, broken links, or unintended data loss may occur.
8. Limitation of liability
To the fullest extent permitted by law, Spellbinder and its operators, affiliates, service providers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, goodwill, or business opportunity arising out of or related to your use of the service.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to Spellbinder will not exceed the greater of $100 USD or the amount you paid us, if any, for the service giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
9. Indemnification
You agree to defend, indemnify, and hold harmless Spellbinder and its operators, affiliates, service providers, and licensors from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your content, your misuse of the service, or your violation of these Terms of Service.
10. Suspension and termination
We may suspend or terminate your access to Spellbinder at any time, with or without notice, if we reasonably believe you have violated these Terms of Service, created risk for users or the service, or if we discontinue the service.
You may stop using Spellbinder at any time. If account deletion is available in your account settings, you may use that feature to request deletion of your account. Some information may remain in backups, logs, caches, or records required for security, fraud prevention, legal compliance, dispute resolution, or legitimate operational needs, as described in our Privacy Policy.
11. Changes to these Terms
We may update these Terms of Service from time to time. If we make material changes, we may update the date above and, where appropriate, provide additional notice. Your continued use of Spellbinder after updated terms become effective means you accept the updated terms.
